Customer Agreement

Customer agreement and liability waiver for Mapleworx services.

Scope of Work

Mapleworx Service Inc. ('Mapleworx') provides property care and maintenance services (the 'Work') at a specified property (the 'Premises') for a property owner, or authorized occupant or agent (the 'Customer'). Each quote, invoice, or subscription ('Work Order') together with these terms forms the agreement.

Liability, Environmental Conditions & Insurance

Mapleworx shall perform the Work using methods, equipment, and materials consistent with standard practices in the property maintenance industry for similar services in similar conditions. Mapleworx takes great care in performing the Work, but some results are naturally limited by weather, materials, physical conditions, and third party factors. Mapleworx's total liability for any claim is limited to the greater of (a) the fees paid by the Customer for the affected service type during the six months before the event giving rise to the claim, or (b) $1,000. Mapleworx is not liable for indirect or consequential loss and does not guarantee perfect, immediate, or permanent results (for example, bare pavement, spotless surfaces, or healthy vegetation) unless otherwise stated in writing. Exterior surfaces are inherently variable and can be slippery, especially in winter; the Work reduces but cannot eliminate natural hazards, and Customers, occupants, and visitors must use caution. This limit excludes damage or injury caused by Mapleworx's gross negligence or wilful misconduct. Mapleworx maintains commercial general liability and WSIB coverage; Customers should maintain their own property insurance.

Post-Service Conditions & Indemnity

Because property and weather conditions change after each visit, Mapleworx cannot control events once the Work is complete. Work is complete when Mapleworx personnel depart the Premises, with each recurring service visit constituting separate completed Work. The Customer then assumes responsibility for changing conditions including those caused by occupants, visitors, third parties, municipal activity, Customer-supplied materials or equipment, and environmental factors such as weather, vegetation growth, and re-soiling. The Customer releases and holds harmless Mapleworx, its employees, contractors, and agents, from claims, losses, or damages arising from those conditions or from property states not created by Mapleworx, and agrees to indemnify and defend Mapleworx against any third-party claims (including legal fees and costs) arising from conditions at the Premises after Work is complete or from the Customer's property, except where caused by Mapleworx's active negligence during performance of the Work. Each Party may assume the defence of any claim it is asked to indemnify, provided it acts reasonably.

Customer Responsibilities, Delays, Payments, Cancellation, Photos, Contractors, Updates and Resolutions

  • The Customer will provide clear access; remove obstacles such as vehicles, debris, or other objects; identify hazards, irrigation, uneven terrain, or fragile items; secure pets; and provide necessary access codes or keys.
  • The Customer acknowledges that property ownership includes responsibility for visitor safety and that Mapleworx's services do not transfer or eliminate the Customer's duties under the Occupiers' Liability Act (Ontario).
  • Service times are approximate and may vary due to weather, traffic, or events beyond Mapleworx's control. When delays occur, Mapleworx will work with the Customer to reschedule or adjust the visit fairly.
  • Payment is due as shown on each Work Order. The Customer authorizes Mapleworx to charge the payment method on file for all completed Work, approved extras, and applicable fees.
  • Cancellations within one business day or failed access will incur a fee equal to 25% of the scheduled Work value; recurring or subscription services renew automatically unless cancelled in writing 30 days before the next cycle.
  • Photos or short videos may be collected by Mapleworx for documentation, training, or quality assurance.
  • Mapleworx may use independent contractors or subcontractors under its direction to perform all or part of the Work.
  • The current version of this Agreement is available at www.mapleworx.ca/agreement. These terms may be updated by notice (email, SMS, or portal) deemed received when sent. Updates take effect 30 days after notice unless the Customer objects in writing. Continued service after that date constitutes acceptance.
  • This Agreement is governed by Ontario law. Disputes shall be resolved in good faith or by Kitchener courts.

Acceptance

By signing, confirming online, or accepting a Work Order, the Customer acknowledges having read and understood this Agreement and agrees to be bound by its terms. Electronic acceptance and copies are deemed originals.
